Published Excerpts on the
Meal Allowance Class Action Lawsuit
(
The class action on meal allowances
is now before the courts.)

March 2002-- Truckers and Professional drivers are being asked to get involved in a class action suit.
Ron Smith of Smitty's Income Tax Service is spearheading a drive to return meal allowance funds back into your pocket.
"Tax men, and federal employees get a food allowance of $70. per day. The truckers get enough to feed a horse, cow or pig."

April 2002-- Ron Smith of Smitty's Income Tax Service tells us, "For the average trucker who has been driving 10-years or more this could mean a return of $20-to-$40-thousand. As well, in the future, truckers will be able to claim a meal allowance of --the current rate allowed to federal employees. It's time to stand up for our rights."

December 2002-- The deadline for the Class Action Lawsuit on Meal Allowance claims has been reached. The class action suit is based on the Charter of Rights and Freedoms and the common law principles like unjust enrichment.
Your claim will be made through your accountant. What the accountant claims--if awarded by the courts, is yours to keep. An accountant has estimated that this case is worth $2.7 billion a year. If this money is spent for meals, tires, equipment etc. the industry as whole will benefit and the government will get increased tax benefits through CCRA.                                                                              As time has passed the case has become more complex as the law has changed considerably in the last months and continues to evolve. Some of the case law developments are favourable and

some are not.
January 2003--Class actions normally require only one representative plaintiff. This case will likely be the biggest so far in Canada and could be the toughest to win. For legal and strategic reasons, as well as to demonstrate the nation wide support we have, there will be eleven plaintiffs in this action. They reside in all jurisdictions in Canada. These fine women and men and the claimants they represent are:
1. from Newfoundland, Earl Wall, Port-Aux-Basques; representing 2 claimants
2. from PEI, Chris Murphy, Summerside; 4 claimants.
3. from Nova Scotia, Fred Meister, Walton; representing 29 claimants.
4. from New Brunswick, Daniel MacDonald, Lower Knoxford; 45 claimants.
5. from Quebec, Paul Persechino, Pierrefonds; 23 claimants.
6. from Ontario, Cindy Jean Rogers, London; 517 claimants.
7. from Manitoba, Joyce Lappage, Inglis: 330 claimants.
8. from Saskatchewan, Holly Prockner, Rouleau; 129 claimants.
9. from Alberta, Patricia (Pat) Angell, Delburne; 383 claimants.
10. from British Columbia, Ron Smith, Penticton; 418 claimants.
11. from the Yukon, Carol Howie, Whitehorse; 10 claimants. Total claimants in class action: 1892. Support these people they represent you! (Two claimants are from the US)
